ATLANTA – The former Atlanta police officer who shot and killed Rayshard Brooks last week was charged Wednesday with felony murder and 10 other allegations, the Fulton County District Attorney’s Office reported.
Garrett Rolfe, 27, shot Brooks, also 27, in the parking lot of an Atlanta Wendy’s last Friday. Rolfe responded to the scene after a restaurant worker found Brooks asleep at the wheel of his car in the drive-thru lane and called 911.
Brooks was compliant until Rolfe and officer Devin Brosnan attempted to take him into custody for suspected DUI. Brooks struggled with both policemen, eventually taking one of their stun guns and running away. During a brief foot chase, Brooks turned and fired the stun gun at Rolfe, who then shot him twice in the back and once in the buttocks. Brooks was pronounced dead at a local hospital.
Rolfe is also charged with five counts of aggravated assault, one count of first-degree criminal damage to property and four counts of violation of oath by an officer.
Prosecutors say Rolfe kicked Brooks after he was shot and Brosnan stood on his shoulders as Brooks was “struggling for his life.” Brosnan is charged with one count of aggravated assault and two counts of violation of oath.
“There is an Atlanta policy that requires that the officers have to provide timely medical attention to Mr. Brooks, to anyone who is injured,” Fulton County District Attorney Paul Howard said. “But after Mr. Brooks was shot, for a period of two minutes and 12 seconds, there was no medical attention applied to Mr. Brooks.”
Howard added that Brosnan is cooperating with the investigation and is willing to testify for the state.
